The Role

The Director of Compliance and Dispute Resolution (PO - Standard Scale) will be a key member of the Senior Management Team, with collective responsibility for leading the successful establishment and effective operation of the Gambling Regulatory Authority. The Director of Compliance and Dispute Resolution (PO) will report directly to the Chief Executive Officer.

This role offers an exciting opportunity to contribute significantly to the evolving landscape of gambling regulation in Ireland. The Director will lead the development and implementation of regulatory compliance measures and dispute resolution mechanisms in the gambling industry. They will ensure the effective monitoring of compliance with legislative provisions and resolve disputes arising in the gambling sector, thereby safeguarding consumer interests.


Principal Duties and Responsibilities

 

  • Lead on the development of the Code of Practice for the industry, and oversee the development of up to 40 Statutory Instruments, to promote the interest of consumers and to protect vulnerable gamblers and children from gambling harm.
  • Develop and lead an effective systematic reporting, audit and investigation regime to ensure compliance with the Codes of Practice, the Gambling Regulation Act and other relevant regulation.
  • Direct periodic specialist inspections and organise & oversee Data Analytics to identify emerging issues or prohibited behaviours (e.g. targeting problem gamblers) and to inform evidence based policy making.
  • Liaise very closely with, and advise the ICT development team, play a central role in developing the ICT systems underpinning compliance.
  • Develop and maintain strong networks with gambling regulators in other jurisdictions, the research community and software developers to share learnings on emerging software or e-gaming, online gambling or other relevant products.
  • Foster an effective regulatory relationship with licencees, including educational supports or best practice guidance where required (e.g. for charities or smaller organisations).
  • Develop and maintain strong networks with a number of public sector bodies with whom the GRAI will share common objectives, as appropriate and develop strong stakeholder engagement networks with industry, health sector, NGOs and others.
  • Develop and oversee an Alternative Dispute Resolution scheme for consumer complaints and keep up-to-date with relevant legal, operational and compliance & dispute resolution developments in other jurisdictions in relation to on site and on line gambling, gaming and lotteries.
  • Oversee verification of industry compliance with Anti-Money Laundering requirements.
  • Oversee industry compliance with Sports Integrity requirements.
  • Develop whistleblowing arrangements to support industry employees or contractors.
  • Set, benchmark and report on KPIs to demonstrate achievement of GRAI deliverables and improvements in compliance in the sector.
  • Attend meetings of the GRAI Authority, Independent Appeals Board, Audit & other GRAI Comittees and relevant Oireachtas Committees and provide updates and presentations as required.
  • Manage the performance of staff in the Monitoring, Compliance and Dispute Resolution department.
  • Any other duties as may be assigned by the CEO from time to time.
Essential Criteria

In order to be eligible to apply for this role you must have/demonstrate in your application form that you meet the following essential criteria:

•    A minimum of a Bachelor’s degree (Level 8 under the QQI Framework) in a relevant field such as Law, Public Administration, Business or a related discipline.
•    A minimum of 10 years of experience in a compliance, regulatory, audit or legal role in the public or private sector.
•    A minimum of 5 years’ experience in a senior management role with demonstrated leadership and strategic planning capabilities.
•    Extensive experience in developing and implementing regulatory/compliance frameworks, compliance and dispute resolution.
•    Demonstrated ability to develop and implement statutory Codes of Practice and Conduct.
•    Strong understanding of audit, investigation, and systematic reporting processes.

Desirable Criteria

The Role - Overview

The Director of Enforcement and AML (PO) will report directly to the Chief Executive Officer.

This position offers an excellent career opportunity to make a significant contribution to the delivery of Enforcement, AML, Sports Integrity services insofar as they relate to Gambling in a dynamic start-up organisation with a wide range of responsibilities. This critical role involves overseeing the enforcement of gambling regulations, ensuring compliance with AML standards within the gambling sector, and maintaining sports integrity in the context of gambling activities. The Director will play a key role in defending the GRAI's decisions in Judicial Reviews, overseeing sanctions for breaches of the Gambling Regulation Act, enforcing anti-money laundering measures specific to gambling, and addressing sports integrity concerns directly related to the industry.

Key Responsibilities: 
  • Lead and manage the defence of Judicial Review cases to ensure robust representation of the GRAI’s decisions and prepare detailed briefs and evidence support the GRAI’s position in court.
  • Lead the development and implementation of the GRAI Enforcement strategies, including standard procedures for a range of proportionate and escalating responses to mitigate risks and ensure compliance with statutory obligations.  
  • Revise such strategies to reflect Court decisions involving GRAI or other precedents of relevance to the Authority, ensuring this learning is carried through to work practices in other GRAI areas.  
  • Oversee Legal proceedings to enforce sanctions in the event of breaches of the regulations in line with the Gambling Regulation Bill 2022, including substantial financial penalties of up to €20m, suspension of a gambling licence, revocation of a gambling licence or imposition of a condition on a gambling licence.
  • Lead and manage the summary prosecutions on behalf of the Authority (Class A fine or imprisonment for a term not exceeding 12 months).
  • Oversee the GRAI’s role in relation to prosecution on indictment including fine or imprisonment, liaising closely and effectively with the DPC, Gardai and other bodies in this regard. 
  • Lead on the legal aspects of measures to effectively counter Black Market activity. 
  • Manage the contract with and performance of the Legal Services Contractor, appointed following Public Procurement, developing a strong, effective professional partnership. 
  • Liaise effectively with enforcement counterparts in other EU Gambling Regulatory Authorities
  • Act as the Competent Authority for Ireland’s international obligations in relation to the prevention of the use of Gambling for the purposes of Anti-Money Laundering and Counter Terrorism Financing, ensuring that we meet all of our EU and our IMF obligations. 
  • Develop and maintain policies and effective procedures to protect the integrity of sports betting.
  • Lead the engagement with a broad range of stakeholders including sporting organisations, An Garda Siochana, other Gambling Regulators and gambling organisations to address match fixing and other breaches of Sports Integrity via the manipulation of gambling. 
  • Represent the GRAI in meetings, conferences, and other forums to promote compliance and integrity within the gambling industry.
  • Manage the performance of staff in the Monitoring, Enforcement and AML department.

Essential Criteria

  • At the date of application have been called to the Bar of Ireland and/or have been enrolled as a solicitor in the State for at least 7 years (experience can be cumulative).

Reporting to the Assistant Director of Licensing, the Licensing Manager, Legal/Professional (HEO - Standard Scale) will be a critical role responsible for ensuring that gambling operators applying for licences have appropriate corporate structures in place and that their policies and procedures comply with the Gambling Regulation Act and associated regulations.

Supporting the Assistant Director of Licensing (AP), the successful candidate will review the suitability and viability of applicants, ensuring adherence to relevant legal standards and codes of practice. This role requires a thorough understanding of complex corporate structures and regulatory compliance.

Key Responsibilities: 
  • Ensure operators applying for gambling licences have appropriate corporate structures and adhere to the Gambling Regulation Act and associated regulations.
  • Review and assess the suitability and viability of licence applicants, focusing on their corporate policies and procedures, including Anti-Money Laundering, Know Your Customer, Player Safety and other relevant documents and processes.
  • Interpret and apply relevant laws, regulations, and codes of practice in the licensing process.
  • Provide advice and guidance on complex corporate structures and compliance issues.
  • Conduct detailed examinations of corporate structures and financial statements of applicants, assessing their viability for licence application and issuing recommendations to Assistant Directors and other relevant members of staff.
  • Liaise with senior staff, licence applicants, and external stakeholders to ensure a clear understanding of licensing requirements and processes.
  • Provide clear and concise communication regarding legal and regulatory standards.
  • Plan and oversee records and file management in a GDPR-compliant manner.
  • Ensure records are maintained to the standard required in the event of a court challenge.
  • Administer a large fee register on a self-financing basis, ensuring accurate and efficient processing of fees.
  • Any other duties as may be assigned from time to time.

Essential Criteria

In order to be eligible to apply for this role you must have/demonstrate in your C.V. and/or Cover Letter the following:

  • A Bachelor’s degree in Law, Business Administration, Regulatory Compliance, or a related field.
  • Experience in administering or applying for licences in a comparable complex application or licensing regime.
  • Proven ability to interpret and apply laws, regulations, and codes of practice.
  • Experience in analysing corporate structures and finances.
  • Excellent communication skills, with the ability to liaise effectively with senior staff and licence applicants.
  • Strong planning and organizational skills, with experience in GDPR-compliant records and file management.

Desirable Criteria
  • Experience in administering a large fee register on a self-financing basis.
  • Previous experience in the gambling or regulatory industry.
  • Experience in public sector, including familiarity with government processes, regulatory frameworks, and public service values.

  • Interpret and update gambling and gaming technical standards, ensuring all operators are compliant with current regulations and codes of practice.
  • Liaise regularly with third-party test houses to ensure they meet required standards and maintain a robust relationship with technical stakeholders.
  • Maintain a thorough understanding of the latest developments in gambling and gaming products and technologies.
  • Monitor and enforce compliance with gambling regulations, providing guidance and updates to operators as necessary.
  • Administer and maintain a comprehensive register of third-party test houses, ensuring all details are current and accurate.
  • Prepare detailed reports on the suitability and viability of operators' technical capabilities for senior management review.
  • Any other duties as may be assigned from time to time.

Essential Criteria

  • Strong understanding of gambling regulations and codes of practice.
  • Ability to interpret and update technical standards in the gambling and gaming sectors.
  • Excellent analytical and problem-solving abilities.
  • Strong communication and interpersonal skills, with the ability to engage effectively with a range of stakeholders.
  • Detail-oriented with strong organizational skills.
