About CEA
Established in July 2022 under the Companies (Corporate Enforcement Authority) Act 2021, the CEA’s statutory mandate derives principally from the Companies Act 2014.
The CEA also has responsibilities under the Irish Collective Asset-management Vehicles Act 2015 and acts as the authority for sanctioning company directors under the Companies (Statutory Audits) Act 2018.
The CEA’s functions include the:
- encouragement of compliance with the Companies Acts;
- investigation of instances of suspected offences under the Companies Acts;
- enforcement of the Companies Acts, including the prosecution of offences by way of summary proceedings;
- referral of cases, as appropriate, to the Director of Public Prosecutions for consideration as to whether they should be prosecuted on indictment; and
- exercise, insofar as considered necessary or appropriate, of a supervisory role over the activity of liquidators and receivers in the discharge of their functions under the Companies Acts.

About the Roles
The CEA wishes to appoint four Senior Legal Advisors, and to establish panels from which further appointments of Solicitors and Barristers might, if necessary, be made over the lifetime of the panel.
The CEA is inviting applications from suitably qualified and experienced Solicitors and Barristers for these roles.
Senior Legal Advisors at the CEA handle a diverse portfolio of legal matters, including innovative and groundbreaking work in company law, civil, and criminal law.
They will gain experience in various legal areas, such as EU Law, administrative law, public procurement law, data protection law, and freedom of information law.
The successful candidates will need strong judgment, analytical, interpersonal, and organisational skills to ensure legal compliance, risk management, and effective contribution to the Directorates’ management.
Principal Duties and Responsibilities
The responsibilities associated with this challenging and demanding role are wide and varied. In that context, the following is a non-exhaustive overview of some of the principal duties and responsibilities associated with the position.
Providing Legal Advice
The statutory remit of the CEA is broad, and the successful candidates will be able to deliver high quality, well researched, and robust legal advice and drafting on all aspects of the CEA’s activities and functions, in contentious and non-contentious matters including core areas such as:- company law,
- civil law and procedure,
- criminal law and procedure
- administration law, and
- insolvency law.
- Managing the relationship and the ongoing provision of external legal advice and relationships with external legal advice providers, whilst monitoring the service quality and cost effectiveness.
- Monitoring legislative changes and relevant case law and updating affected business areas on these changes and developments.
- Provide high quality, clear and timely legal advice on all aspects of the CEA’s law functions including policy, investigations and enforcement action.
Involvement in Litigation
- Advising and managing District Court enforcement proceedings on behalf of the CEA
- Assisting (on a multi-disciplinary basis) in the preparation of files for cases that will be tried in the Circuit Court, from before a file is sent to the Director of Public Prosecutions to the disclosure at trial stag.
- Responsibility for preparing for, supporting, and managing, civil litigation where the CEA is a litigant or notice party, including, for example, investigating the conduct of companies, judicial review, and restriction/disqualification of company directors and applications to appoint Inspectors .
- Directing the preparation legal briefs for external lawyers, particularly in the context of litigation, ensuring quality and consistency.
- Recovering costs awarded to the CEA in litigation.
- Providing advice on privacy, data protection and freedom of information law.
Working as Part of a Team
- Establishing and developing strong collaborative relationships across the CEA.
- Managing competing priorities and tasks in an effective manner.
- Working effectively, individually and as part of a team, with other legal professionals and across the organisation.
- Performing any other duties and/or legal services as assigned from time to time.
- Contributing to the development and the utilisation of the new proposed case management system as it relates to knowledge management and indeed as it relates to using the case management system generally supporting the Data Protection Officer in advice and projects relating to data protection matters
Leadership
- Lead and manage the performance and development of junior members of the team within the CEA including setting goals and empowering them in their roles
- Liaise and maintain effective and professional working relationships with external parties, including external legal counsel, government officials, other enforcement agencies and the European Commission.

About the Role
The CEA is seeking to fill 2 posts of Higher Legal Executive.
The successful candidate will experience a varied and challenging portfolio of responsibilities and involvement in work that is both innovative and ground-breaking in company law, civil and criminal law and will primarily be involved with managing assigned files under supervision, attending prosecution counsel, attending court, costs accounting in the Office, liaising with court staff. They carry their own file loads under appropriate supervision in the office, and they are required to manage these file loads and prioritise effectively.
The successful candidate will be required to carry out duties in one or more of the different Legal Directorates of the Authority. They will report to, in the first instance, to the Senior Legal Advisors.
Principal Duties and Responsibilities
The functions list below is non-exhaustive and successful candidates will be required to perform other duties as appropriate to the posts which may be assigned from time to time and to contribute to the development of the post.
Among other tasks, the successful candidate will primarily engage the following:
• Managing assigned files under appropriate supervision.
• Engaging with internal and external stakeholders, including counsel, witnesses, An Garda Síochána, and the Court Service in relation to casework.
• Preparing of legal documents for service and filing e.g., Production Orders, Notices of Motion and Affidavits supporting applications to the Courts.
• Supporting prosecuting lawyers in court e.g. District Court proceedings, Judicial Review matters.
• Processing legal costs, accounting and legal costs recovery work.
• Assisting in the training, development and management of legal executives, trainee law clerks or administrative staff.
• Maintaining case notes and complete post-court administration including updating the case management system and physical files.
• Utilising of the ICT case management systems and applications to obtain the maximum benefits from these tools, including IT tools to manage disclosure obligations.
• Contribute to the development of processes and procedures in relation to data quality, case management and reporting metrics in line with our strategic objectives.
• Contribute to the overall management and strategic development of research and analysis services within the CEA.
• Contribute to the overall development of the CEA and wider organisation by sharing their knowledge and experience.
• Any other duties, including administrative, which may be deemed appropriate by CEA senior management from time to time.
All Higher Legal Executives work collaboratively and proactively to provide support as needed colleagues in their own team and across the Divisions and the organisation.
